1. Acceptance of Terms

Welcome to our online confectionery store. By accessing or using our website, placing an order, or engaging with our services in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and TABRIFICS LTD.

If you do not agree with any part of these terms, you must not use our website or purchase our products. You must be at least 16 years of age to place an order on this website. By placing an order, you confirm that you meet this age requirement and have the legal capacity to enter into binding contracts under the laws of Scotland and the United Kingdom.

All products are made fresh to order in small batches at our facility in Aberdeen, Scotland. Product availability, flavours, and specifications are subject to change without prior notice, though we endeavour to keep our website information current and accurate.

3. User Obligations

When using our website and services, you agree to:

  • Provide accurate, current, and complete information when placing orders or communicating with us
  • Use the website only for lawful purposes and in accordance with these Terms of Service
  • Not engage in any activity that could damage, disable, overburden, or impair our website or interfere with any other party's use of the site
  • Not attempt to gain unauthorised access to any portion of the website, other accounts, computer systems, or networks connected to our servers
  • Not use any automated system, including robots, spiders, or scrapers, to access the website or extract data without our express written permission
  • Not impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Not upload or transmit viruses, malware, or any other malicious code that could affect the functionality of our website
  • Not engage in any fraudulent activity, including use of stolen payment methods or provision of false contact information

Failure to comply with these obligations may result in immediate suspension or termination of your access to our services, and we reserve the right to report illegal activities to relevant law enforcement authorities.

4. Intellectual Property Rights

All content on this website, including but not limited to text, graphics, logos, images, product photographs, descriptions, recipes, design elements, software code, and compilation of content, is the exclusive property of TABRIFICS LTD or its content suppliers and is protected by United Kingdom and international copyright, trademark, and intellectual property laws.

Our traditional Scottish recipes, product formulations, and manufacturing processes constitute valuable trade secrets and proprietary information owned by TABRIFICS LTD. You are granted a limited, non-exclusive, non-transferable licence to access and use the website for personal, non-commercial purposes only. This licence does not include any right to:

  • Reproduce, duplicate, copy, or resell any portion of the website or its content
  • Use our recipes, product formulations, or manufacturing methods for commercial purposes
  • Modify, adapt, translate, or create derivative works based on our content
  • Use our trademarks, service marks, trade names, or logos without prior written authorisation
  • Frame or mirror any part of the website on any other server or internet-based device

Any unauthorised use of our intellectual property may result in legal action and you may be held liable for damages, including costs and legal fees.

5. Product Information and Pricing

We strive to ensure that all product descriptions, images, ingredients lists, allergen information, and pricing displayed on our website are accurate and current. However, we do not warrant that product descriptions, photographs, or other content on the website are complete, reliable, current, or error-free.

All prices are displayed in British Pounds Sterling (GBP) and include VAT at the applicable rate unless otherwise stated. Delivery charges are calculated separately and displayed before you complete your purchase. We reserve the right to change prices at any time without prior notice, though price changes will not affect orders already placed and confirmed.

Product photographs are for illustration purposes and may differ slightly from the actual products due to the handmade nature of our confectionery. Variations in colour, size, and appearance may occur between batches, as each is crafted individually. Such variations are inherent to artisan food production and do not constitute grounds for returns or refunds unless they affect food safety or quality.

In the event of a pricing error or product description inaccuracy, we reserve the right to cancel or refuse any orders placed at the incorrect price or based on incorrect information. We will notify you promptly if this occurs and offer you the option to place a new order at the correct price.

6. Orders and Payment

When you place an order through our website, you are making an offer to purchase products subject to these Terms of Service. All orders are subject to acceptance by TABRIFICS LTD. We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases where:

  • Products are unavailable or out of stock
  • We suspect fraudulent activity or unauthorised payment method use
  • Pricing or product information contains errors
  • We are unable to deliver to the specified address
  • You have breached these Terms of Service

Order confirmation emails are sent automatically upon receipt of your order and do not constitute acceptance. Acceptance occurs when we dispatch your order and send you a shipping confirmation email. At that point, a binding contract is formed between you and TABRIFICS LTD.

Payment is processed securely through authorised payment providers at the time you place your order. We accept major credit cards, debit cards, and other payment methods as displayed at checkout. You confirm that you are authorised to use the payment method provided and that sufficient funds or credit are available to complete the transaction.

All transactions are subject to fraud screening and verification. We may contact you to verify order details before processing. Failure to respond to verification requests within 48 hours may result in automatic order cancellation.

7. Delivery and Shipping

We offer delivery services throughout the United Kingdom and to selected international destinations. Delivery costs, estimated delivery times, and available shipping methods are displayed at checkout before you complete your purchase. All delivery timeframes are estimates only and are not guaranteed.

Orders are typically dispatched within 1-2 working days for orders placed before midday Monday through Thursday. Orders placed from Thursday afternoon through Sunday are dispatched the following Tuesday to ensure maximum product freshness. You will receive email notification with tracking information once your order has been dispatched.

Delivery times may be affected by factors beyond our control, including courier delays, weather conditions, customs processing for international orders, and public holidays. We are not liable for delays caused by third-party courier services, though we will assist in tracking and resolving delivery issues where possible.

You are responsible for providing a complete and accurate delivery address. If a delivery fails due to incorrect address information, refusal of delivery, or unavailability of recipient, redelivery charges may apply. Undelivered packages returned to us may incur restocking fees before a refund is processed.

Risk of loss and title for products pass to you upon delivery to the specified address. We recommend inspecting packages immediately upon receipt and reporting any damage or missing items to us within 48 hours of delivery.

8. Returns, Refunds, and Cancellations

Due to the perishable and food safety nature of our products, we can only accept returns of unopened, unused products in their original sealed packaging within 7 days of delivery. To initiate a return, you must contact us at [email protected] with your order number, reason for return, and photographs of the product if applicable.

You have the right to cancel an order within 14 days of receipt under the Consumer Contracts Regulations 2013, provided the products remain sealed and unopened. Opened food products cannot be accepted for return due to health and safety regulations. Return shipping costs are the customer's responsibility unless the return is due to an error on our part or a defective product.

If you receive damaged, defective, or incorrect products, please contact us immediately with photographic evidence. We will arrange for replacement or full refund, including return shipping costs, at our discretion. Claims for damaged or defective products must be made within 7 days of delivery.

Refunds are processed to the original payment method within 14 days of our receipt and acceptance of the returned product. We reserve the right to deduct costs incurred for partial consumption, damage, or packaging degradation from any refund amount.

Order cancellations are accepted up to 24 hours after placing the order, provided production has not commenced. Cancellation requests must be submitted in writing to [email protected]. Orders already in production or dispatched cannot be cancelled.

9. Allergen Information and Food Safety

Our confectionery products contain dairy ingredients including milk, butter, and cream. Some products may contain nuts or be produced in facilities where nuts are handled. Full allergen information is provided on product packaging and is available on request before purchase.

While we take reasonable precautions to prevent cross-contamination, we cannot guarantee that any product is completely free from allergen traces due to our production environment. If you have severe allergies or specific dietary requirements, please contact us before placing an order to discuss suitability.

Customers are responsible for reviewing allergen information and determining suitability for their own consumption or for gift recipients. We cannot be held liable for allergic reactions resulting from consumption of our products where appropriate allergen information has been provided.

Products should be stored in cool, dry conditions away from direct sunlight and consumed within the timeframe indicated on packaging. We recommend consumption within 2-4 weeks of production for optimal quality and freshness.

10. Disclaimers and Limitation of Liability

Our website, products, and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

  • Your use or inability to use our website or services
  • Unauthorised access to or alteration of your data
  • Third-party conduct or content on the website
  • Any products obtained through the website
  • Delivery delays or non-delivery by courier services

Our total liability to you for any claims arising from your use of the website or purchase of products shall not exceed the amount you paid for the specific product giving rise to the claim, or £100, whichever is lower.

Nothing in these Terms of Service excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under United Kingdom law.

11. Indemnification

  • Your violation of any law or the rights of any third party

The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent as closely as possible.

Our failure to enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
